What is PC1000 Diversion? Its Implications for Immigrants Arrested at Coachella or Stagecoach?
Penal Code 1000 gives those convicted of simple possession of drugs an opportunity to undergo treatment and education instead of serving jail. The accused must enter a “guilty” plea, following which the drug diversion program of 18 months must be completed. Then, the charges are dropped, and usually, there is no criminal record left.
Eligibility for PC1000 pretrial drug diversion entails that the charges must be of drug possession for personal use. A charge of possessing drugs for sale or transportation renders a defendant ineligible for PC1000 diversion.
For immigrants and non-US citizens, a PC1000 diversion could render them ineligible to stay in the United States. While it may sound like an appealing proposition to get a criminal case dismissed via PC1000, it gives Homeland Security the right to terminate your stay in the country because of the diversion.

- Your medical marijuana card is not a license for you to smoke weed at Coachella or Stagecoach. In fact, Coachella spells this out unambiguously on its website. You cannot smoke weed at the festival. A medical marijuana card is a recommendation and not a prescription. Federal law considers marijuana consumption illegal.
- There will be a lot of undercover policepersons at Coachella, and you don’t have to be guilty to be targeted.
